General terms and conditions of participation

1. Scope of application

The website www.repachallenge.ch and the mobile application “RE:PAS CHALLENGE,” as well as the services offered through these platforms (hereinafter collectively referred to as “RE:PAS CHALLENGE”), are developed and provided by the association ZEROWASTE SWITZERLAND (hereinafter referred to as “ZEROWASTE”). These General Terms and Conditions (GTC) govern the relationship between ZEROWASTE and all parties participating in RE:PAS CHALLENGE, in particular companies, coordinators, team leaders, and participants (hereinafter referred to as “participants”). By registering for RE:PAS CHALLENGE (cf. Art. 2), the parties declare that they accept these GTC. Registered companies and participants undertake to inform all concerned parties in detail of these GTC, as well as of those concerning data usage in accordance with Art. 10. The parties undertake to consider participation in RE:PAS CHALLENGE only from individuals who declare their acceptance of the provisions of these GTC.

2. Registration

Registration for RE:PAS CHALLENGE takes place online and requires companies registering for the initiative, respectively the individuals carrying out the registration (the coordinators), to provide accurate information in the registration forms. These individuals are responsible, in particular, for ensuring that participants have been duly informed of the conditions of participation and that their consent has been obtained. They are also responsible for ensuring that the number of employees stated during registration corresponds to the actual size of the company. This means they must indicate the actual number of employees working in the company, not a potential number of participants.

3. Team creation and participation process

All team members must be employees of the company registering for the initiative. Participation can be individual or in groups. However, only teams will be entered into the draw for collective prizes.

4. Prioritizing reusable containers and solutions for meals and drinks consumed

During RE:PAS CHALLENGE, the goal is to prioritize reusable containers and solutions for meals and drinks consumed during working hours over a period of 7 days. Employees working from home may record the reusable containers they used on teleworking days. Participants record daily the reusable items they have used (in accordance with Art. 4) until 28 September 28, 2025, at 11:59 p.m. 2025, à 23h.59. 

5. Duration and termination of the contract

The company, respectively the coordinator (the individual who registered the company), undertakes to participate for the full 7 days of RE:PAS CHALLENGE. Termination is not possible. The contractual relationship between ZEROWASTE and the participants ends at the conclusion of RE:PAS CHALLENGE. Once RE:PAS CHALLENGE is over, participants lose their right of access to their user account, as well as to the company and team accounts, unless otherwise requested. Personal data collected is retained by ZEROWASTE , which may use it in accordance with Art. 10 of these GTC 10 des présentes CG until the next year’s challenge or within a period of 1.5 years.

6. Participation fees and payment terms

Not applicable for the 2025 edition.5.

7. Contest prizes

Every individual registered for RE:PAS CHALLENGE is automatically entered into the draw for individual prizes. Teams are automatically entered into the draw for collective prizes provided that each participant fulfills the participation conditions of the draw. The lists of winners for individual and collective prizes will be published by newsletter to participants no later than the week of October 6, 2025. The winners’ first and last names will appear on the lists, along with the team name for collective prize winners. In principle, winners collect their prizes directly from the sponsor. plus tard la semaine du 6 octobre 2025 par newsletter aux participants. Le nom et le prénom du gagnant figureront sur les listes, de même que le nom de l’équipe dans la liste des gagnants des prix collectifs. En principe, les gagnant.e.s récupèreront leur prix directement auprès du sponsor. 

8. Intellectual property

Participants acknowledge the intellectual property rights of RE:PAS CHALLENGE (intellectual property, related rights, and others), in particular copyrights, patent rights, trademarks, designs, and know-how, which belong exclusively to ZEROWASTE. Any reproduction or use, e.g., of images, audio documents, video sequences, and/or texts in another electronic or printed publication and/or in the press, is strictly prohibited without the prior authorization of the rights holder. 

For third-party software and materials required to use the website and mobile application, third-party rights prevail.  

10. Data protection

By registering for RE:PAS CHALLENGE and accepting these GTC, participants authorize ZEROWASTE to use the personal data provided for information emails about ZEROWASTE and RE:PAS CHALLENGE, for surveys, and for evaluations. The names, first names, and email addresses of participants who win prize draws, as well as the company name and business address, will be shared with sponsors for the purpose of delivering prizes. 

Data provided to ZEROWASTE by participants, or parts thereof such as company data (i.e., company name, company logo [optional], location and canton, number of employees, number of participants, number of teams, CO2 equivalence, and avoided waste in kilograms) will be published on the website www.repaschallenge.ch. Participating companies can see, during the challenge, which other companies are also participating. 

Data automatically generated by the mobile application (tracking function) may be processed anonymously by ZEROWASTE and passed on to third parties for research purposes. Sponsors and partners may use photo and video material, if available, to illustrate their websites, winner lists, or for marketing purposes (e.g., for printed material or media activities). 

The person responsible for registration undertakes to do so only after having expressly informed participants of data usage according to these provisions and after obtaining their clear consent. The parties concerned guarantee that data processing and entry are carried out in compliance with applicable data protection laws and that they use the data entered and published only within the framework of ZEROWASTE. Unless previously agreed with ZEROWASTE, any other use, particularly for advertising or mailings of any kind, is prohibited.

ZEROWASTE undertakes to handle all personal data in accordance with the Swiss Federal Data Protection Act. Anyone wishing to object to their address being passed on to prize sponsors must send a written request to geneve@zerowasteswitzerland.ch. If the website or mobile application provides the option to enter personal or professional data (email address, name, residence, etc.), participants provide such data voluntarily. 

10. Liability

ZEROWASTE’s liability is generally limited to gross negligence and intentional acts. In particular, ZEROWASTE cannot be held responsible for any errors, inaccuracies, or omissions in the information provided and published on the website www.repaschallenge.ch and in the RE:PAS CHALLENGE mobile application. Direct and/or indirect links to third-party websites are excluded from ZEROWASTE’s liability. Accordingly, any responsibility for the content or access to such sites is declined. Other liabilities, especially for indirect damages (such as loss of profit or possible extra costs, etc.) or for material or immaterial damages incurred after accessing, using, or failing to use the information provided, which could arise from misuse or technical issues (e.g., caused by third parties), are expressly excluded. 

All information provided is for guidance only. ZEROWASTE reserves the right to modify, supplement, delete, or temporarily or permanently discontinue parts or all of the website and mobile application without prior notice. 

11. Final provisions

12.1 Amendments and additions to the contract Any side agreements, amendments, or additions to these GTC must be made in writing. This also applies to any dispute of this written form requirement. ZEROWASTE may amend these GTC after the end of the contract duration and the Challenge.

11.2 Partial invalidity

If certain provisions of these GTC are found to be null or invalid, the validity of the other provisions of the contract shall remain unaffected. In such a case, the invalid clause shall be replaced by a valid clause whose economic effect comes as close as possible to that of the invalid clause.

11.3 Jurisdiction and applicable law The contract is governed exclusively by Swiss law, excluding conflict-of-law provisions. For any disputes that may arise from this contract, the parties agree that the place of jurisdiction shall be Lausanne.
